The terms on which Sydney Mobile Car Inspections arranges and carries out mobile car inspections across Sydney.

This website and its subdomains (the Site) are operated by Rasesh Koirala, advertising and trading as Sydney Mobile Car Inspections, ABN 99 683 699 605 ("Sydney Mobile Car Inspections", "we", "us" or "our"). These Inspection Service Terms (the Terms) govern the basis on which we arrange and provide car inspection services to you (the Customer, "you" or "your").

By booking an inspection with us - whether by phone or through an enquiry on the Site - you confirm that you have read, understood and agree to these Terms. If you are booking on behalf of another person or business, you agree to these Terms for yourself and for them. If you do not agree, please do not book.

1. About these Terms

  • These Terms, together with any quotation or booking confirmation we give you, form the agreement between you and us for each inspection (the Agreement).
  • We may update these Terms from time to time by publishing the updated version on the Site. Any change applies only to bookings made on or after the date it is published, and does not affect rights or obligations already accrued. We recommend you check this page before each booking.
  • Defined terms used in these Terms have the meaning given in clause 16 (Definitions).

2. How our service works

  • Sydney Mobile Car Inspections operates a coordinated network of independent local mechanics and inspectors across Sydney. We provide the booking, the inspection process, the checklist and the reporting standard; the inspection itself is carried out by an independent inspector from our network (an Inspector).
  • We are responsible for the inspection service standard set out in these Terms. We only inspect cars, and we only operate within the Greater Sydney service area described in clause 4.
  • An inspection is an independent assessment of a vehicle's condition for a prospective buyer. It is not a sale, a finance product, an insurance product, or a registration or roadworthy service.

3. Scope of inspections and packages

All inspections are visual and/or non-mechanical. Our Inspector does not dismantle the vehicle or remove any parts or components, and does not raise the vehicle other than as set out in clause 6. We offer two packages:

  • Silver Inspection - from $300. A full visual and system check, a road test, and a 10-minute phone call with your Inspector after the inspection to talk you through what was found. No written report is provided with this package.
  • Gold Inspection - $400. Everything in the Silver Inspection, plus a written report with photos (the Report) that you can keep and use to negotiate.

Each package is subject to the exclusions in clause 10. EV, hybrid, luxury and performance vehicles may be quoted higher because they take longer to inspect. An inspection is not a recommendation to buy or not to buy, and is not a roadworthy certificate. All bookings are confirmed with you over the phone.

4. Service area and travel fees

  • Our Inspectors are based across Greater Sydney and regularly cover Western Sydney, the Hills District, the Inner West, the Northern Suburbs, South Western Sydney and the Hawkesbury. Standard pricing includes travel within these areas.
  • Inspections requested outside these areas (for example, the Central Coast, Blue Mountains, Wollongong or the Hunter) may attract an additional travel fee, depending on the Inspector's location relative to the vehicle. Any travel fee will be quoted and agreed with you before the booking is confirmed.
  • We may decline an inspection in any location where, in our reasonable opinion, it cannot be carried out safely or practically.

5. Booking and contact

  • To book, give us the suburb the car is in, the make and model, and your preferred time, by phone or via an enquiry. We or your Inspector will then contact the person nominated in your booking to arrange a time and confirm the vehicle's location.
  • We only contact Australian telephone numbers and cannot call international numbers.
  • Your booking is confirmed only once we confirm it with you over the phone. Preferred dates and times are requests; confirmed times are subject to Inspector availability.

6. Requirements for the inspection

Before your Inspector attends, the vehicle must:

  • be on a hard, level surface;
  • be in a safe and legal location to inspect;
  • have reasonable walking space around its full perimeter; and
  • be accessible, unlocked and available at the agreed time.

If these requirements are not met: you are entitled to a full refund if you give us at least 24 hours' notice that they cannot be met; otherwise we may proceed but reasonably reduce the scope of the inspection to avoid health or safety risks (for example, a vehicle that is not on a level surface may not be safely jacked).

Road test. Where a road test is included, you must ensure the vehicle has enough fuel or charge to complete it. We will not road test a vehicle that, in our reasonable opinion, is not in a roadworthy condition or is not registered. Vehicles are road tested only to the speed limit of the local area.

Matters outside our control. To the extent permitted by law, we are not liable for any delay or failure to carry out an inspection caused by events outside our reasonable control (for example, extreme weather or the vehicle being unavailable). In those cases we will seek to reschedule to a mutually convenient time.

7. Fees, payment and variations

  • Fees. You agree to pay the fee for the package you select, plus any agreed travel fee (clause 4) and any same-day surcharge. Same-day bookings, where available, attract a $50 surcharge. Unless stated otherwise, all amounts are in Australian dollars and inclusive of GST.
  • Quotes. Any price we give before inspection is an estimate based on the information you provide. The final fee may differ if that information was incomplete or inaccurate, or if the vehicle type or location differs from what was booked.
  • Variations. If a change to the agreed fee is needed (for example, the vehicle is a different class, or is located outside the standard service area), we will explain why and seek your agreement before proceeding.
  • How you pay. Payment method and timing will be confirmed at booking. By providing payment details you confirm you are authorised to use that payment method.

8. Rescheduling, cancellations and refunds

  • Rescheduling. You may reschedule a booking on up to two occasions. If you cannot proceed after rescheduling a second time, the booking must be cancelled and a new booking made if required.
  • Cancellation by you. If you cancel with at least 24 hours' notice, you are entitled to a full refund. If you cancel with fewer than 24 hours' notice, you are entitled to a refund less a cancellation fee equal to 40% of the fee. If you cancel with fewer than 2 hours' notice, you are entitled to a refund less a cancellation fee equal to 60% of the fee.
  • Cancellation by us. We may decline or cancel an inspection for any vehicle or location, in which case you receive a full refund of the fee paid for that inspection.
  • Nothing in this clause limits any refund or remedy you are entitled to under the Australian Consumer Law.

9. The Report and verbal summary

The Gold Inspection includes a written Report (which may include photos). The following applies to the Report, and to the verbal summary given on the Silver Inspection call:

  • Subject to applicable law and clause 11, we do not warrant or guarantee the nature, reliability, accuracy or completeness of any information in the Report or summary, or its fitness for any particular purpose.
  • The Report and summary are not a recommendation to purchase or not to purchase. The decision to buy is yours, having regard to your own circumstances, investigations and enquiries.
  • They reflect the vehicle's condition as observed at the time of inspection only. You should consider the age and condition of the vehicle in that context, and inspect the vehicle again at the time of sale.
  • Our Inspector uses accepted methods of fault detection, but these may not identify every fault. The faults noted (if any) are not an exhaustive list of all faults with the vehicle.
  • We do not check manufacturer recall notices, assess compliance against factory specifications, verify odometer accuracy, or carry out public-record searches (such as a PPSR or written-off check). You are responsible for those searches.
  • The Report is not a roadworthy certificate and cannot be used as one. We do not guarantee that the vehicle would pass a road authority inspection.

10. What is not inspected (excluded items)

Because every inspection is visual and non-mechanical, the following are examples of items that are not assessed:

  • engine cylinder compression, and internal engine, gearbox or transmission mechanics;
  • brake function beyond what is immediately visible, brake fluid contamination, and ABS internals;
  • the cause of any oil or fluid leak, and the remaining life of clutches, exhausts or timing/drive belts;
  • vehicle electronics and computer systems, and driver-assistance technologies (lane keeping, adaptive cruise, blind-spot or collision-avoidance systems);
  • air-conditioning efficiency, the age of tyres, and the condition of high-voltage hybrid or electric drive batteries (a 12V start battery check is included);
  • recall status, factory-specification compliance, and the standard to which any prior repairs or servicing were completed.

This list is illustrative, not exhaustive. If a particular item matters to you, please raise it before booking so we can tell you whether it is within scope.

11. Liability

Non-excludable rights. These Terms do not exclude, restrict or modify any right or remedy you have under a law that cannot be excluded, including the Australian Consumer Law (ACL). Where we are liable for a failure to comply with a consumer guarantee that cannot be excluded (other than a guarantee implied by law that cannot be limited), our liability is limited, at our option, to resupplying the inspection service or paying the cost of having it resupplied.

To the maximum extent permitted by law:

  • all implied guarantees and warranties relating to our inspection services (other than the non-excludable rights above) are excluded;
  • our total liability arising under or relating to these Terms will not exceed the greater of (i) $1,000 and (ii) five times the total fees you paid us for the service giving rise to the liability;
  • we are not liable for loss of use, profit, revenue, business, data or anticipated savings, or for any indirect or consequential loss; and
  • we are not responsible for the terms of any transaction, or for resolving any dispute, between you and a seller, dealer or any other third party in relation to a vehicle we inspect.

In this clause, references to Sydney Mobile Car Inspections include our Inspectors, contractors, employees and agents. So that any claim can be assessed fairly, you must notify us of any claim for loss or damage in writing within 7 days of the inspection.

12. Your responsibilities and warranties

  • You must be at least 18 years old and have the legal capacity to enter into this Agreement.
  • You must ensure the vehicle is available at the agreed location and time, and arrange access with the seller if the vehicle is not yours.
  • You must give your Inspector any material information you have about the vehicle - for example its service history, whether it is unregistered (and why), any major repairs, or any structural or accident damage. We rely on this information and are not responsible if the inspection or Report is inaccurate because information you provided was inaccurate or incomplete.
  • You must treat our staff and Inspectors courteously, and the information you give us must be true and accurate.

13. Intellectual property

Where a Report is provided, it is licensed to the person named on the booking for their own use. You must not provide the Report to a third party without our prior written consent. All intellectual property rights in our services, including the Report and our checklists and templates, remain ours.

14. Privacy

We collect, hold and use personal information (such as your name, contact details and vehicle details) only to provide and improve our services, and we handle it in accordance with the Privacy Act 1988 (Cth). We do not sell your personal information.

15. General

  • Governing law. These Terms are governed by the laws of New South Wales, Australia, and each party submits to the non-exclusive jurisdiction of the courts of that State.
  • Notices. Notices to us may be given by phone on (02) 9053 8785 or by email to hello@sydneymobilecarinspections.com.au.
  • Entire agreement. These Terms, with any quotation and booking confirmation, are the entire agreement between us and supersede earlier discussions.
  • Severance. If any provision is found to be unenforceable, it is severed to the minimum extent necessary and the remaining provisions continue in force.
  • Waiver and assignment. A failure to enforce a right is not a waiver of it. You may not assign this Agreement without our consent; we may assign or sub-contract our obligations (including to an Inspector in our network).
  • Survival. Clauses that by their nature should continue (including clauses 9, 11, 12 and 13) survive completion or termination of the Agreement.

16. Definitions

  • ACL means the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
  • Customer means the person who books an inspection with us.
  • Inspector means an independent local mechanic or inspector from our network who carries out an inspection.
  • Report means the written report (which may include photos) provided with a Gold Inspection.
  • Silver Inspection and Gold Inspection have the meanings given in clause 3.
  • Site means sydneymobilecarinspections.com.au and its subdomains.
